4. TICKETS

4.1. General
a) The ticket constitutes proof that a contract has been entered into between the Company and the passenger whose name appears on the ticket.

b) Carriage on a flight will only be accepted for persons who have been issued a ticket. The Company will only arrange carriage for the person whose name appears on the ticket. The passenger may be asked to identify themselves. Valid identification includes a valid passport, a valid bank/credit card with a personal photo, a valid driving licence, and a military service book. Passengers travelling with children under 2 years of age must, upon request, present the child’s birth certificate. If the passenger cannot prove that they are the person whose name appears on the ticket, the Company may refuse carriage. In such cases, any right to a refund or compensation will lapse.

c) If you have lost or forgotten your ticket or booking documentation, you may contact the airport staff at check-in or by email or telephone.

A printed reservation is not required for check-in. It is important that you have noted your booking number. In all cases, the reservation must be valid for the relevant departure in order for you to travel.

d) In certain cases, one or more passengers holding tickets for a route may be carried together with one or more passengers who have chartered the aircraft to fly to a specific destination, or vice versa. In such cases, the entire flight is generally considered a charter flight. Individual passengers holding tickets for a route are protected in the same manner as on a regular scheduled service. However, the passenger must accept any intermediate landing and stop en route.

4.2. Validity of the ticket
A ticket is only valid as long as it is confirmed in accordance with the Company’s rules described in Article 6.1.a.

5. FARES AND TAXES, FEES, ETC.

5.1. General
Fares apply only to carriage between the departure airport and the arrival airport, unless otherwise specifically stated. The fare is calculated according to the price applicable on the day the ticket is booked for travel on a specific date. If you change the travel date, this may result in a change in the fare.

5.2. Valid prices
Valid prices are the prices applicable at the time of reservation. Prices may vary. The Company cannot guarantee that tickets will be available. A ticket is only reserved once payment has been accepted. If tickets in one fare class are sold out, the next cheapest ticket will be offered. This may occur during the purchase process if there are campaigns. The applicable price is always the price shown in the payment window where card details are entered.

5.3. Taxes, charges and fees
Applicable taxes and charges imposed by public authorities or airport authorities must be paid by the passenger. When the passenger books the ticket, they will be informed of any taxes and charges not included in the fare. Taxes and charges imposed on air travel change from time to time and may therefore be imposed after the ticket has been booked and/or issued. In such cases, the passenger must pay the increase that has occurred from the date the ticket was booked and purchased until the departure date. If such a tax or charge is removed or reduced so that it no longer applies to the passenger’s journey on the day of departure, the passenger is entitled to a refund, provided they contact the Company.

Booking fees and any credit card fees are calculated at payment, before the payment is completed. In the event of a refund, the fee is not refunded.

5.4. Currency
Fares and taxes must be paid in the currency specified by the Company at the time of reservation.

6. BOOKING CONDITIONS

6.1. Personal data
The passenger acknowledges that the personal data received by the Company has been provided with the intention of purchasing a ticket. In accordance with these assumptions, the passenger grants the Company the right to store and use such data and to disclose it to its own offices, authorised agents, the relevant authorities and airlines, or others performing the services mentioned above. The passenger’s personal data will not be used for marketing purposes unless the passenger has given prior consent.

a) The ticket is only confirmed, or is only deemed confirmed, once payment has been received. If the ticket is not paid immediately, the Company may freely cancel the passenger’s booking.

b) Fares and rights are fixed at the time of booking, and any restrictions or fees for changes/cancellation of the ticket are disclosed to the passenger at that time.

6.2. Seating
The Company does not assign a specific seat on the aircraft (there is open seating). Please speak to us if you have special requests. The flight crew may at any time require passengers to sit in a specific place.

6.3. Non-use of ticket
All tickets that are not used on a flight become invalid and will not be refunded.

6.4. Name change, cancellation and rebooking of ticket
Applies to all ticket types. Rebooking and cancellation are done via self-service by clicking into your account in the upper left corner of our website:

  • As an existing customer, select “Log in”.
  • As a multi-ride pass customer, select “Multi-ride pass log in”.

You can also change the ticket by clicking “Search reservation” on our website and entering the booking number and surname. Unfortunately, this option is not available for multi-ride pass customers.

  • You must use the same email address and password used when booking the ticket.
  • There you can log in at any time of day.
  • Therefore, it is an advantage for each passenger to have all information so that you can change the ticket yourself outside normal office hours.
  • If you require assistance with rebooking or cancelling your ticket outside NORDIC Seaplanes’ normal office hours, we will be pleased to help for a fee of DKK 600.
  • Common to tickets that can be cancelled is that we do not refund the money; instead, the amount is returned as points to your NORDIC Seaplanes account. These points can be used as payment for a later ticket purchase.
  • Points credited to the account upon cancellation are valid for 36 months from the credit date. After expiry, the points lapse automatically and cannot be redeemed or paid out in cash.

6.5. Expiry of points, including multi-ride passes
Points, including points awarded as a result of purchasing a multi-ride pass or as a result of a cancelled ticket, expire at the end of a month 3 years after they were issued. Examples: if issued on 5.10.2022, they expire on 30.10.2025. If issued on 3.3.2023, they expire on 31.3.2026.

6.6. Use
Discount points—the so-called multi-ride passes—can only be used for purchases online, for purchases in connection with changing a ticket, or for a rebooking fee. All other purchases must be paid by payment card or MobilePay, and no discount is granted.

7. CHECK-IN AND BOARDING

7.1. Meeting time
The latest time to present at check-in is 20 minutes before departure in both Aarhus and Copenhagen. The Company reserves the right to cancel the ticket if the passenger does not comply with the stated deadlines and requirements for check-in. Check-in deadlines are also available on the Company’s website or can be provided upon request to the Company. Tickets are not refunded.

If the passenger is not present at boarding, the passenger’s ticket will be considered used. Under no circumstances will the flight be delayed, and the passenger will be denied boarding if they arrive later, unless the Company decides otherwise. The Company is not responsible for any loss or expenses incurred by the passenger as a result of failure to comply with these provisions.

7.2. Onward connections
The Company only sells point-to-point tickets. This means that tickets booked in the Company’s ticketing system do not create liability for onward connections, and you cannot be checked in to other destinations.

7.3. Online check-in
Online check-in is not available.

7.4. ID documents
All passengers must be able to present valid photo identification at check-in and boarding. The Company reserves the right to refuse passengers who cannot present valid identification. See Article 4.1 b).

8. REFUSAL AND LIMITATION OF CARRIAGE

8.1. Right to refuse carriage
The Company may, at its reasonable discretion, refuse to carry passengers or baggage, even if the Company has given the passenger written notice that it will arrange carriage of the passenger on the booked flights. In such case, the passenger is entitled to a refund. The Company may also refuse to carry passengers or baggage if one or more of the following circumstances has occurred, or if the Company has reason to believe they may occur:

a) Such action is necessary to comply with applicable laws, regulations or other provisions issued by a public authority.

b) Carriage of the passenger or their baggage may endanger the safety and/or

the health of other passengers and/or the crew.

c) Carriage of the passenger or their baggage may cause inconvenience or nuisance to passengers and/or the crew.

d) The passenger’s conduct, age, mental or physical health, including being under the influence of alcohol or narcotic substances, may cause danger or risk to the passenger themselves or to fellow passengers, the crew or the aircraft, or the passenger requires special assistance from the Company that it is unable to provide.

e) The passenger has behaved improperly on previous flights, and the Company has reason to believe that such improper behaviour may occur again.

f) The passenger has refused to comply with a security check.

g) The passenger has not paid the relevant fare, taxes or charges.

h) It appears that the passenger does not have valid travel documents and intends to destroy them during the flight, or refuses to hand over travel documents to the flight crew if requested.

i) The passenger presents a ticket that has been obtained unlawfully, or that has been purchased from parties other than the Company, or that has been reported lost or stolen, is a forgery, or the passenger cannot prove that their identity corresponds to the name shown on the ticket.

j) The passenger fails to follow the air carrier’s safety instructions.

k) The passenger has previously committed one of the acts or omissions mentioned above.

In the cases mentioned above in a–k, a written warning will not be necessary, and the Company will cancel the reservation without liability to refund the ticket or cover other expenses.

8.2. Special requests and needs
There may be special requests or needs, such as passengers with disabilities, children travelling alone, and customers who wish to bring a pet or require general assistance. All special requests and needs must be applied for, and this must be done no later than 48 hours before departure. As we use special aircraft, unfortunately we cannot always offer carriage to everyone.

8.2.1. Reservation of special requests and needs
If you require a wheelchair, wish to bring a pet, or require general assistance, you must contact the Company first.

8.2.2. Electric wheelchairs
We cannot transport electric wheelchairs.

8.2.3. Pregnant passengers
The following rules apply to pregnant passengers flying with the Company:

Weeks 1–34 of pregnancy: No restrictions.

Weeks 35–37 of pregnancy: Accepted upon presentation of a medical certificate confirming that the pregnant passenger is fit to fly.

From week 38 of pregnancy: Cannot travel with the Company.

If you have any further questions, please contact us by telephone on 70 20 00 60 or email us at fly@seaplanes.dk.

8.2.4. Infants
Infants must always travel with an adult, and only one infant per adult is permitted. Infants (children under 2 years) must sit with an adult passenger. The infant does not have their own seat. The adult will be provided with a special infant safety belt. The safety belt must always be fastened when required. Infants are not permitted to use a car seat during take-off and landing on the Company’s flights. The Company reserves the right to a maximum of 2 infants per departure.

8.2.5. Children – and children travelling alone (UM)
A UM (Unaccompanied Minor) is a child in the age group from 8 up to and including 15 years who travels without an accompanying adult. The Company has the following rules for children and children travelling alone. Prices are the same as for adults unless there are special offers.

The Company may deviate from these terms and conditions at any time if deemed necessary and/or following an individual assessment.

Children under 8 years
As a general rule, cannot travel unaccompanied. As we do not fly with cabin crew, children may only travel unaccompanied if they can look after themselves during the journey. Children under 8 must therefore normally travel with an accompanying person who is at least 16 years old.

Children from 8 years
A child may only travel unaccompanied if they can look after themselves during the journey. A guardian MUST be present until departure, and another guardian must be present when the aircraft arrives; this must be confirmed before the aircraft takes off. The Company CANNOT assume responsibility for the child after arrival.

To book tickets for children travelling alone, please contact the Company by email as stated above. These tickets cannot be booked online, and we reserve the right to availability, as we have a limit on the number of unaccompanied children per departure.

Please note that check-in for children travelling unaccompanied is no later than 30 minutes before scheduled departure. Prior to check-in, a form is completed for the child with contact details for both the child and the “sender and recipient”.

If the aircraft lands at an airport other than originally planned, for example due to weather, an unaccompanied child will be sent by taxi to the destination.

Children from 16 years
A child between 16 and 18 years may travel unaccompanied on the same terms as adults.

9. BAGGAGE

9.1. Items not accepted as baggage
The passenger must not place the following in their baggage:

a) Items that are not baggage according to the definition in Section 1.

b) Items that may expose the aircraft, persons or cargo on board the aircraft to damage and/or danger, such as the items specified in the Dangerous Goods Regulations of the International Civil Aviation Organization (ICAO) or the International Air Transport Association (IATA).

c) Items whose carriage is not permitted under applicable laws, regulations or provisions.

d) Items that, in the Company’s opinion, are unsuitable for carriage because they are considered a safety hazard, or because they are unsuitable for carriage due to weight, size, shape or other characteristics, or that are fragile or perishable.

e) Live animals, except as described in Section 9.10.

f) Weapons and ammunition, other than sporting or hunting weapons, are prohibited. Sporting and hunting weapons must in all cases be unloaded and secured, and otherwise properly packed. Finally, the bolt/fore-end must be sent separately from the rest of the weapon.

g) The passenger must not place fragile items, perishable or valuable items, electronic equipment, jewellery and precious stones, money, security documents, document folders and attaché cases with an installed alarm, medicines, medical certificates or identification documents in checked baggage.

h) It is prohibited to bring replica weapons, daggers, (switch)knives and other similar offensive items as carry-on baggage, but these may be accepted as checked baggage.

i) If items referred to in Section 9 are nevertheless included in the passenger’s baggage despite being prohibited, the Company is not liable to the passenger for loss of or damage to such items.

9.2. Right to refuse carriage
a) The Company will not carry as baggage items as described in Section 9.1.

b) The Company will not carry as baggage items that, due to their size, shape, weight, contents or other characteristics, are not suitable for carriage on board the aircraft. In general, all baggage must weigh less than 23 kg per item.

c) The Company will not accept baggage for carriage that is not properly packed in suitable packaging, so that under normal conditions the Company can ensure it arrives undamaged.

9.3. Right to conduct inspection
For security reasons, the Company may request to inspect the passenger’s baggage, or call airport authorities to conduct a body search. If the passenger cannot be present during the inspection of baggage, the Company may, for security reasons, inspect the baggage to ensure that the passenger has not brought items described in Section 9.1 that are not approved by the Company under this Article.

9.4. If the passenger refuses to comply with the request, the Company may refuse carriage of the passenger and baggage.

9.5. Checked baggage
a) When baggage is handed over to the Company for check-in, the Company will normally ensure that the baggage is brought on board.

b) The passenger is obliged to attach a label to the baggage, both inside and outside, containing at least name and address.

c) Checked baggage will preferably be carried on the same aircraft as the passenger.

9.6. Baggage restrictions

Passengers may bring baggage in accordance with the Company’s rules and limitations as set out in the Company’s or subcontractors’ operations manuals. As a general rule, only 1 item of carry-on baggage of a maximum of 6 kg may be brought, and if a ticket including checked baggage has been purchased, 1 item of checked baggage of a maximum of 23 kg. For total weight reasons, the Company may choose to send baggage on a later departure.

9.7. Oversized baggage or overweight
Passengers must purchase a separate ticket type to bring baggage or carry-on baggage that exceeds the specified weight limit of 6 kg for carry-on baggage. Information regarding tickets can be obtained upon request from the Company or on the Company’s website.

9.8. Carry-on baggage
a) Baggage carried as carry-on baggage may in total weigh a maximum of 6 kg with standard dimensions. Items that the Company finds to be of such a size and/or weight that they cannot be transported will not be accepted as carry-on baggage and must be carried as checked baggage, for which a separate ticket type must be purchased.

b) Items that cannot be carried in the aircraft’s cargo hold (for example fragile musical instruments, dialysis machines, etc.) will only be accepted in the cabin if the Company has been informed in advance and has granted permission. The passenger should expect a cost for carriage of such items.

9.9. Collection and delivery of checked baggage
a) The passenger must collect their checked baggage as soon as it is available at the place of arrival or stopover.

b) Only the person who checked in the baggage has the right to collect the checked baggage.

c) If a person claims delivery of baggage and cannot identify the baggage, the Company will only deliver the baggage if the person can satisfactorily prove ownership.

9.10. Animals
a) The Company does not accept live animals for transport in the baggage compartment.

b) Animals (dog or cat) must be placed in a Company-approved transport crate/box or travel bag. The crate, box or bag must be watertight and the bottom must contain a water-absorbing mat that fits the size of the box. Together with any carry-on baggage, the animal may weigh a maximum of 6 kg; otherwise, it must be paid for as baggage.

c) Animals are only accepted if the Company has been informed in advance.

d) Guide dogs can normally be carried.

e) The passenger is fully responsible for loss, illness, death or injury to animals accepted for transport, unless the Company has acted negligently. The Company also assumes no responsibility for fines, costs or losses incurred in connection with an animal being denied travel for any reason. Any costs will be charged solely to the passenger.

f) If it is assessed that the animal may be a nuisance to other passengers, the Company may refuse to transport the animal as well as the passenger.

g) If there are staff or passengers on board the desired departure who have a severe allergy to fur-bearing animals, the passenger with the animal will be asked to disembark and will be offered free rebooking to the next available departure.

10. TIMETABLES AND CANCELLATIONS

Timetables

10.1.The air carrier (NORDIC Sky Ltd.) shall do its best to carry passengers and baggage in the most appropriate manner. It shall also do its best to follow the published timetable applicable on the day of carriage. The scheduled times in the air carrier’s published timetables are not guaranteed and may change from the time the timetable is published until the date the passenger wishes to travel.

The Company reserves the right to make time changes right up until departure and cannot be held liable for delays caused by extraordinary circumstances or weather, etc.

10.2. Irregularities
Punctuality will always be a high-priority goal for the Company, and we work purposefully to get our aircraft away on schedule. Nevertheless, irregularities may occur. As a general matter, we refer to the following websites where information on passenger rights in the event of irregularities can be found:

www.flypassager.dk

www.trafikstyrelsen.dk

We also refer to the applicable EU Regulation No. 261/2004.

10.2.1. Delays
In the event of delays of up to 1 hour and 15 minutes, there is no right to cancellation, rebooking or other changes. In the event of delays exceeding 1 hour and 15 minutes, the Company offers passengers the option to cancel, rebook or change without restrictions or costs. This also applies to any return journey. Tickets are always refunded as points.

In the event of delays you are entitled to refreshments if you have presented at the gate no later than 20 minutes before the scheduled departure, provided the delay exceeds two hours. This includes meals in proportion to the waiting time, possibly also overnight accommodation if a new journey is offered the next day, necessary transport between the airport, the place of accommodation and back to the airport, two telephone calls, a fax message or email. Meals/food vouchers will not be distributed in cases where this would further delay the departure.

10.2.2. Cancellations due to extraordinary circumstances
Extraordinary circumstances are events that could not have been avoided even if all reasonable precautions had been taken. This may, for example, include:

- Weather conditions and the consequences of weather conditions from earlier departures.

- Technical defects that arise acutely and affect flight safety.

- Strike or other labour dispute affecting operations.

- Airspace restrictions due to Air Traffic Control (ATC).

- Illness among the crew that could not have been foreseen.

- Other unforeseen circumstances/events that pose a safety risk to the departure.

- If your departure is cancelled due to any of these circumstances, the Company will offer you alternative departures at no additional cost to you, provided capacity is available. Passengers will be moved to new departures with priority as follows: the most expensive tickets are moved first; thereafter, in the order in which customers booked.

You may also change your journey to later departures where we have available capacity. This also applies to any return journey. If the purpose of your journey no longer applies, you may apply to the Company for a refund.

In the event of landings at locations other than the planned airports, the Company will, to the greatest extent possible, arrange onward transport—most often by taxi, shared with any other passengers, and only to the destination airport.

10.2.3. Cancellation due to controllable circumstances
Controllable circumstances may, for example, include:

- planned route changes for commercial reasons.

- route changes for other reasons within the Company’s control.

- foreseeable technical reasons.

- lack of staffing that should have been foreseen.

If your journey is cancelled due to controllable circumstances, you are entitled to a refund of the journey and the return journey if you do not wish to use it. You may also choose rebooking of the journey at no additional cost to you. In addition, you are entitled to meals in proportion to the waiting time, overnight accommodation if a new journey is offered the next day, and coverage of transport costs between the airport, the place of accommodation and back to the airport, two telephone calls, fax messages or email. In addition, you are entitled to compensation depending on the length of the journey. This amounts to: EUR 250 for flights up to 1,500 kilometres. You are not entitled to this compensation if the Company informed you of the cancellation:

- earlier than 14 days before departure

- between 7 and 14 days before departure, provided you are offered an alternative that entails departure no more than two hours before the scheduled departure time and gets you to your destination no later than four hours after the scheduled arrival time.

- less than 7 days before departure, provided you are offered an alternative that entails departure no more than one hour before the scheduled departure time and gets you to your destination no later than two hours after the scheduled arrival time.

10.4. Changed departure times.
It may happen that the Company must change departure times after the ticket has been issued. If the passenger provides details of how they can be contacted, the Company will attempt to notify the passenger of such changes. If the Company, after the passenger’s purchase of the ticket, changes the departure time significantly and the passenger cannot accept this, and the Company cannot provide the passenger with a seat on an alternative departure that can be accepted, the passenger is entitled to a refund in accordance with Article 11. In addition, the provisions of Article 10.3 may apply.

10.5. Denied boarding
In the event of voluntary “denied boarding”, you are entitled to rebooking on an alternative departure, provided capacity is available, or a refund of the journey. You are also entitled to compensation of EUR 150. In the event of involuntary denied boarding, you have the same rights as in the event of cancellation due to controllable circumstances (see Section 10.2.3).

11. REFUNDS

11.1. General
If the Company cannot arrange carriage of the passenger, the ticket will be refunded by the Company in accordance with this Article and its rules. All refund claims must be sent by email to the Company. A ticket can only be refunded if it corresponds to a confirmed paid ticket booking and the passenger has a ticket that, under the Company’s rules at the time of issue, is considered eligible for a refund.

11.2. Recipient of refund
a) Unless otherwise stated, the Company shall make the refund either to the person whose name appears on the ticket or to the person who paid for the ticket, provided satisfactory proof of such payment can be presented.

b) If a ticket has been paid for by someone other than the person whose name appears on the ticket, the Company will make the refund exclusively to the person who paid for the ticket, or pursuant to a power of attorney from that person.

11.3. Refund in connection with the Company’s cancellation
If the Company cancels a flight or fails to provide a previously confirmed ticket, the amount to be refunded shall be:

a) If no part of the ticket has been used, an amount equal to the fare.

b) If part of the ticket has been used, the refund shall not be less than the difference between the fare and the applicable price for travel between the destinations where the ticket has been used.

c) Credit card fees are not refunded.

11.4. Voluntary refund
If you are entitled to a refund for reasons other than those mentioned in 11.3, the refunded amount shall be:

a) If no part of the ticket has been used, the refunded amount shall be the same as the fare less any administrative costs and cancellation fee.

b) If part of the ticket has been used, the refunded amount shall be calculated in relation to the difference between the fare and the applicable price for travel between the airports where the ticket has been used, less any administrative and cancellation fees.

11.5. Refund of the tax/charge portion (“tax”) of the ticket upon cancellation
Payment for economy tickets cannot, as a general rule, be refunded. However, public taxes and charges on unused journeys may be refunded upon request to the Company.

11.6. Right to refuse refund
If the ticket’s expiry date has passed, the Company may refuse a refund, with the exception of taxes and charges which will be refunded.

11.7. Currency
The Company reserves the right to refund in the same manner as the ticket was paid for, and in the same currency.

11.8. Authorisation to refund
Only the Company may make refunds.

12. CONDUCT ON BOARD

12.1. General
If a passenger behaves on board the aircraft in such a manner that they endanger the safety of other persons on board, or are suspected of intending to cause damage to the aircraft and its equipment, or if the passenger prevents the flight crew from performing their duties, or fails to comply with instructions from the crew on board, including but not limited to smoking (e-cigarettes), consumption of alcohol or narcotics, or behaves in such a manner that it causes inconvenience or nuisance to other passengers and/or the crew, the Company may take the measures it considers necessary to prevent the continuation of such behaviour. This also includes the use of force. The passenger may be removed from the aircraft, denied carriage from any airport, and may be reported to the police for criminal offences committed on board. ANNEX 1

Air carriers’ liability in respect of passengers and their baggage: This information contains a summary of the rules on liability applicable to EU air carriers under EU legislation and the Montreal Convention.

Compensation in the event of death or injury: There are no financial limits to liability for compensation in the event of a passenger’s injury or death. For damages up to 113,110 SDR, the air carrier may not contest the claim for compensation. The air carrier may contest a higher claim only by proving that it was not negligent or otherwise responsible for the damage.

Advance payment: If a passenger is killed or injured, the air carrier must make an advance payment to cover immediate economic needs within 15 days after the identity of the person entitled to compensation has been established. In the event of death, this advance payment may not be less than 18,096 SDR.

Destroyed, lost or damaged baggage: The air carrier is obliged to pay compensation for destroyed, lost or damaged baggage up to 1,131 SDR. In the case of checked baggage, the Company is obliged to pay compensation even if it has not been at fault, unless the baggage was defective. In the case of unchecked baggage, the Company is obliged to pay compensation for damage when it has been at fault.

Complaints regarding baggage: In the event of damaged, delayed, lost or destroyed baggage, the passenger must notify the air carrier in writing as soon as possible. In the event of damage to checked baggage, the passenger must complain in writing within seven days, and in the event of delay within 21 days, in both cases calculated from the day the baggage is made available to the passenger.

Liability of contracting carriers and operating carriers: If the air carrier operating the flight is not the same as the contracting air carrier, the passenger may choose which of the air carriers to send the complaint to or claim compensation from. If an air carrier’s name and code are stated on the ticket, this is the contracting air carrier.

The Company shall not be liable if it can prove that the Company and its employees took all precautions to avoid the damage, or that it was impossible for the Company or its employees to take such precautions.

If the person collecting the baggage accepts the checked baggage without objections, this shall be deemed to indicate that the baggage has been delivered undamaged in accordance with the conditions of carriage. In any event, the Company’s liability is limited to proven damages.

15.1.2. The Company confirms that it holds liability insurance covering no less than the minimum amount stipulated in applicable laws, conventions or agreements. In such case, the passenger must prove otherwise. If a passenger wishes to submit a claim regarding damage to checked baggage, the passenger must notify the Company as soon as the damage is discovered, and no later than seven (7) days after receipt of the baggage. If a passenger wishes to submit a claim regarding delayed baggage, the passenger must notify the Company no later than twenty-one (21) days after the baggage was made available to the passenger.

Any right to compensation shall lapse if legal action is not brought within 21 days from the date of arrival at the destination, or from the date the aircraft should have arrived, or from the date the carriage was interrupted. Methods for calculating the time limit for legal action are determined by the statutory provisions in the country where the action is brought.

The Company reserves the right to combine flights into a single flight. Cancellation does not apply to round trips, sightseeing or special flights.
